mOTOR Finance commission complaints
The Financial Conduct Authority (FCA) banned the practice of discretionary commission arrangements in the motor industry in 2021. On 11th January 2024, the FCA announced their plan to undertake work on the historic motor finance discretionary commission arrangements across the motor finance industry.
As a result of this review, the FCA have paused the 8-week deadline for motor finance firms to provide a final response to relevant customer complaints. This pause will apply to complaints regarding motor finance agreements where there was a discretionary commission arrangement between the lender and the broker and will last for 37 weeks (approximately 9 months).
This pause will apply to complaints received by firms between 17th November 2023 and 25th September 2024.
Consumers will also have up to 15 months to refer their complaint to the Financial Ombudsman, rather than the usual 6 months. This extension applies to complaints where the firm had sent a final response in the period beginning with 12th July 2023 and ending with 10th January 2024. This also applies where the firm sends a final response during the period beginning with 11th January 2024 and ending with 20th November 2024.
